These Terms are an agreement between you and [Legal entity name] ("we", "us"), which operates Pawdwell — including the Pawdwell desktop application, the getpawdwell.com website, and the services offered through them (together, the "Service"). By downloading the app or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Your account
Some features — creating a pet with AI, chat, purchases — require a signed-in account. You are responsible for activity under your account and for keeping it secure.
You must be at least 18 years old and have reached the age of majority where you live. A parent or guardian cannot authorise a minor to use the Service. We may ask you to confirm your eligibility when you register or first sign in; a third-party sign-in account does not by itself prove your age.
2. Licence
We grant you a personal, non-exclusive, non-transferable licence to install and use the Pawdwell application for your own non-commercial use. You may not:
- reverse engineer, decompile, or redistribute the application;
- resell, share, or sublicense companions or creation credits;
- use the Service to generate content that is unlawful, harmful, or infringes the rights of others.
3. Purchases and credits
Pet creation ($8.80, one-time) buys one AI companion generated from a photo you provide. Subscriptions (Plus $6.99/month, Pro $14.99/month) include a monthly allowance of creations and renew automatically until cancelled. Unused monthly allowances do not roll over.
Payments are processed by Creem, our merchant of record; taxes are handled at checkout. Refunds follow our refund policy. You can cancel a subscription at any time — cancellation stops future renewals and takes effect at the end of the paid period.
4. Your content
You keep all rights to the photos you upload and the companions you create. You give us the limited right to process them (run generation, serve chat) while the Service is operating. We do not use your photos, companions, or conversations to train generalised or cross-user AI models, and we do not permit our AI providers to do so on our behalf.
You confirm you have the rights to the photos you upload. If you upload someone else's pet, a celebrity, or a copyrighted character, that is between you and them — we may remove content in response to a valid complaint.
5. Community companions (Role Square)
Companions in the Role Square are published by their creators. Pressing "Apply" gives you a personal-use licence to that companion. Creators retain rights to their creations.
6. AI output
AI generation is probabilistic: results vary and may contain flaws. The Service is provided "as is" and we do not guarantee any particular quality of output for a given photo. Creations that fail outright are refunded per the refund policy.
7. Acceptable use
Do not attack, overload, or probe the Service; do not scrape it; do not use it to harass anyone. We may suspend accounts that do.
8. Termination
You may stop using the Service and close your account at any time by emailing support@getpawdwell.com from your account address. We complete the deletion within 30 days and confirm by email (see the privacy policy, section 7). We may suspend or terminate accounts that violate these Terms. If we terminate your account without cause, we will refund the unused portion of the current subscription period.
Closing your account removes your cloud data. Companions already downloaded to your device keep working locally, and are removed only when you delete them yourself.
9. Disclaimers and liability
The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. Our total liability for anything arising from the Service is limited to the amount you paid us in the 12 months before the claim. Neither party is liable for indirect or consequential damages.
Nothing in these Terms excludes rights you have under mandatory consumer law in your country of residence.
10. Governing law and changes
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules, except where mandatory consumer law of your country of residence gives you stronger rights. If we make material changes we will notify you in-app before they take effect; continued use after that means acceptance.
